Terms of service.
The agreement between LeadsAfterDusk and the agencies that use it. Version 1.5, 21 October 2026.
Version 1.5 · 21 October 2026.
1. Who these terms are with
LeadsAfterDusk ("we", "us", "our") is LeadsAfterDusk Ltd, company number 17488984, registered office 66 Paul Street, London EC2A 4NA, registered in England and Wales. Contact: hello@leadsafterdusk.com.
These terms apply between us and the business that uses the service ("you", "the agency"). They, and our data processing agreement, are accepted by an owner of your account, when signing up or in the dashboard, who confirms they are authorised to accept them on your behalf. We keep a record of who accepted which version and when. The service is for businesses only, not for consumers: by accepting, you confirm that you are using it for your business. They do not apply to members of the public who write to an agency; our privacy policy explains how their data is handled.
2. What the service does
LeadsAfterDusk reads property enquiries arriving in an inbox you connect and writes a reply in your words, either sending it from that inbox or saving it there as a draft for your staff, depending on the setting you choose below. Where enabled, it can also offer viewing times from a connected calendar and record outcomes.
You choose how each branch replies, and can change it at any time in your dashboard:
- Automatic (the default): straightforward enquiries are answered within minutes, in your words and using only the information you give us. Anything we treat as needing a person - valuations, fees and quotes, legal matters, complaints, and anything outside the areas you cover - is never answered with a guess. The enquirer gets a reply saying a colleague will be in touch when you next open, and the enquiry is flagged for your team.
- Approval: every reply waits in your Drafts for a member of your staff to send.
- Off: enquiries are recorded and no replies are sent.
- Watch only ("Shadow mode"), on the free trial and Pro: we record enquiries and the time your own team first replied to each one, and send and draft nothing, so you can see what arrives while you are closed. We do not keep the content of your team's replies.
Away mode and holiday mode. Away mode makes the service answer straight away during your office hours too, still within your plan's reply window. Holiday mode is for when the office is closed for a few days: for the number of days you choose, every enquiry is answered straight away at any hour, your plan's reply window does not apply, replies treat the office as closed until it ends, and viewing times are only offered after it. It switches itself off when the days are up, and you can switch it off sooner. Each branch can use up to 10 days of holiday mode in each calendar month; unused days do not carry over. A plan with no automatic replies gets none in holiday mode either.
We do not quote fees, or give legal or mortgage advice, in an automatic reply under any setting. A reply may state a price or rent only where it appears in the listings you have given us (section 7).
Viewings. Where you connect a calendar, replies can offer times that look free in it and record the time an enquirer asks for. That is a request for your team to confirm with them. Times offered to one enquirer are held for 12 hours so that we do not offer them to another enquirer in the meantime. The service never books, confirms or commits your diary, your vendor or your landlord to a viewing on its own, and it never writes to your calendar.
Look Back. Someone at your agency can ask for a Look Back report on a connected inbox: we read the messages it received in the previous 60 days (up to 2,000), find the property enquiries among them and show how many arrived while you were closed and how quickly your team answered. Look Back only reads: it sends nothing, drafts nothing and changes nothing in your inbox. Its figures are estimates produced the same way as everything else the service does (section 7), so treat them as a guide.
3. Your account
- An owner can create your agency's account by signing up on our website, or we can create it for you. Accounts are for your staff only, one person per sign-in. The person signing up confirms they are authorised to act for the agency and that the details given are accurate.
- Keep sign-in details secure, use two-step sign-in where you can, and tell us immediately if you think an account has been compromised.
- You are responsible for what your staff do with the service, including replies they choose to send, and for removing anyone who should no longer have access.
- You confirm you are entitled to connect the inbox and calendar you connect, and to let us process the data in them as our data processing agreement describes.
4. Your responsibilities
- You remain responsible for what is sent. Replies are written from the information you give us and the setting you choose. You are responsible for the content of replies sent from your inbox, whether a member of your staff sent them or the service did on your instruction. Check the replies in your dashboard, especially at the start.
- Keep your settings accurate. Replies use the company information you enter. Do not enter anything you would not want repeated to a member of the public.
- Follow the law. You must comply with UK GDPR, PECR and the law and codes that apply to estate and letting agents in how you use the service, including telling enquirers in your own privacy notice that a service provider and an automated assistant may handle their enquiry, and in any marketing you send. We are not responsible for your marketing.
- Do not misuse the service: no unlawful, misleading or abusive content, no connecting a mailbox or calendar you are not entitled to connect, no attempt to break, overload, probe or reverse engineer it, no use to build a competing product, and no reselling it without our written agreement.
- If you break this section. You will make good any loss we suffer from a claim by someone else that results from your connecting a mailbox or calendar you were not entitled to connect, or from content you put into the service, except to the extent the loss was caused by our own breach of these terms or of the data processing agreement.
5. Data protection
We act as a data processor for enquiry data, and you are the controller. Our data processing agreement forms part of these terms and sets out what we do, where data is held and how long we keep it; where the two differ on anything to do with personal data, the data processing agreement wins. Our privacy policy explains how we handle data for which we are the controller.
Replies are written by Google's Gemini model on Google Cloud in its London region; that data is not used to train Google's models. An owner of your account can disconnect any inbox at any time from the dashboard, and we then delete our access to it.
How we keep it secure. All data is encrypted in transit (HTTPS) and at rest. The access token for each connected inbox is encrypted again with AES-256-GCM before it is stored, using a key kept in Google Secret Manager, separate from the data. Your staff can see only your agency's data, and the database enforces this. We use your mailbox only to read enquiries, write or save replies, check whether your team has already answered and, when you ask, produce a Look Back report; we never delete, move or archive your email. If we become aware of a personal data breach affecting your data, we tell you within 48 hours. The privacy policy and the data processing agreement describe these measures in full.
6. Plans, free trial and payment
The free trial
- The trial runs for 14 days from the day your agency's account is created.
- You can spend up to the first 7 of those days in watch-only Shadow mode (section 2), then switch replies on. Watching does not extend the trial.
- We do not take card or bank details to start it. Nothing can be charged during the trial, there is nothing to cancel, and it does not turn into a paid plan by itself. If you choose a plan before the 14 days are up, payment starts straight away and the rest of the free trial ends.
- Trials run with full Pro cover whichever plan you are considering, so you can see what the weekend and early-morning hours are worth to you before you decide anything.
- Near the end we will offer you a short optional call to go through what the service actually caught. You can choose a plan in the dashboard at any time. If you don't, the service pauses when the trial ends: new enquiries are not read, stored or answered, and your dashboard says the trial has ended. Your dashboard and the data already in it stay available, and choosing a plan later switches the service back on straight away. Enquiries are still deleted on the schedule in the data processing agreement, and you can close the account at any time to have everything deleted.
- Either of us can end the trial at any time.
Plans and prices
All prices are per month and exclude VAT. We will add VAT at the prevailing rate once we are VAT registered; until then none is charged.
| Plan | Price | Branches | Automatic replies |
|---|---|---|---|
| Starter | £299 | 1 | Up to 12 hours a weekday, 6pm to 6am by default |
| Pro | £429 | 1 | Up to 15 hours a weekday, 6pm to 9am by default, plus up to 48 hours across the weekend |
- Starter is for one branch. An agency with more than one branch needs Pro.
- Extra branches: £75 a month for each branch beyond the one included with Pro, up to seven in total. You add or remove them yourself in the dashboard.
- Holiday mode is included in both plans: up to 10 days a calendar month for each branch (section 2).
- The hours above are a maximum, not a schedule. Each branch sets its own reply window within its plan's allowance.
- Outside the office hours you tell us, automatic replies run inside your plan's reply window. During office hours they run only if you switch on Away mode, or if nobody on your team has replied within your hand-off time (10 minutes unless you change it), and still only inside your plan's reply window. A Starter plan has no weekend window, so Away mode does not add one. Holiday mode is the one exception: while it is on, replies run at any hour.
Paying
- Card payments are handled by Stripe, our payment provider. You enter your card details on Stripe's own payment page; they go to Stripe and we never see or store them. Stripe's own terms and privacy policy apply to that part.
- Fees are payable monthly in advance, and your plan renews automatically each month on the same date until you cancel. The first payment is taken when you choose a plan.
- Changes you make yourself: switching between Starter and Pro, or adding or removing extra branches, takes effect straight away. Stripe adjusts the charge pro rata for the rest of the month, which appears on your next invoice. Moving to a plan with fewer branches than you are using pauses replies on the extra branches (the oldest branch keeps running); nothing is deleted, and you can archive branches or change plan again at any time.
- Invoices, receipts and your card details are managed in the dashboard under Manage billing.
- Failed payments: if a payment fails, Stripe tries again over the following days and we tell you by email. If it still hasn't been paid, automatic replies pause until it is. Your data is not deleted for a missed payment while your plan is still open.
- If you dispute a payment with your bank instead of contacting us, we may pause the service while the dispute is resolved.
- We can change prices with at least 30 days' notice. If you don't accept a change, you can cancel before it starts.
Cancelling
- You can cancel at any time, in the dashboard under Manage billing or by emailing hello@leadsafterdusk.com. There is no notice period, no minimum term and no contract length.
- The service runs to the end of the month you have already paid for and is not renewed. After that automatic replies stop, and we keep your data for up to 30 days in case you change your mind, then delete it as section 11 describes.
- Except where the refunds section says otherwise, we do not refund part-months.
Refunds
You are a business, so the 14-day cancellation right that applies to consumers buying at a distance does not apply to this contract. What follows is our own policy rather than a legal minimum, and we would rather set it out plainly now than argue about it later.
- Your first 30 days on a paid plan. If the service has not done what we said it would, tell us within 30 days of your first payment and we will refund that first month in full. We will ask what went wrong, because we would rather fix it, but we won't make you justify it.
- After that. We don't refund time already served, or the rest of a month you have paid for. Cancel whenever you like and the service runs the month out.
- If the fault is ours. If automatic replies are unavailable for more than three consecutive days in a month for a reason within our control, we will refund that month pro rata when you ask. Failures at Google, Microsoft, the portals or your own mail provider are not within our control; section 7 sets out what we do not guarantee.
- If we end your plan for a reason that is not your fault, we refund the unused part of the month.
- Agreed refunds go back by the method you paid with, within 14 days of us agreeing one.
7. Limits of the service
- Replies are written by AI, and AI can get things wrong. The replies, and the judgements behind them (whether an email is a genuine enquiry, whether it is a sale or a let, whether the place it mentions is in the areas you cover, which topics need a person, which times look free in your calendar, and the figures in a Look Back report), are produced by an AI model. It is right most of the time but not all of the time. It can misread an email, misjudge a location, word something inaccurately, miss an enquiry or treat something else as one.
- What we do about that. Replies only use the information you give us; they never quote a price unless it appears in your published listings; a reply that contains a price, phone number, address or link we didn't expect is held as a draft instead of being sent; and the topics in section 2 are handed to your team rather than answered. These safeguards reduce mistakes. They do not remove them.
- What we ask of you. Look over replies in your dashboard, particularly in your first weeks, and tell us about anything that is wrong so we can correct it. If a branch needs every reply checked before it goes out, use Approval. A reply is a first response on your behalf: it is not an offer, a contract, a valuation, or legal, financial or mortgage advice, and it does not commit you to a viewing or a tenancy.
- Viewing times are not bookings. Holding offered times reduces the chance of two people being offered the same slot, but your calendar is the only record of your diary, and your team confirms every viewing.
- Automatic replies run only within the hours your plan allows, within the reply window you set, or while holiday mode is on.
- We do not guarantee that every enquiry will be answered, or answered within any particular time. Email delivery, Google's and Microsoft's services, portal formats and network failures are outside our control.
- If our system cannot reply, the enquiry is still recorded for your team wherever possible.
- The service is provided "as is". We do not promise it is free of faults or fit for any particular purpose beyond what these terms say.
8. Availability and support
We aim to keep the service running at all times but do not promise a specific uptime during free trials. Planned maintenance is notified by email in advance where we can. Support is by email to hello@leadsafterdusk.com; we aim to reply within one working day.
We may suspend the service, or part of it, straight away if we reasonably need to: to protect it, other customers or the people whose data it processes (for example during a security incident or if an account appears compromised), or because the law, a regulator or Google or Microsoft requires it. We will tell you why as soon as we can and restore it as soon as the reason has gone.
9. Your content and ours
- You keep ownership of your data, your company information and anything your staff write.
- You grant us permission to process it to provide the service.
- We keep ownership of the software, the website and the way replies are generated. Nothing here transfers that to you.
- If you send us suggestions or feedback, we may use them to improve the service without owing you anything for them.
10. Confidentiality
Each of us will keep the other's non-public information confidential and use it only to provide or use the service. This does not apply to information that is already public through no fault of the recipient, or that the law requires to be disclosed.
11. Ending it
- You can stop at any time in the dashboard or by telling us in writing; you pay for the period already started. Section 6 sets out cancelling and refunds in full.
- We can end or suspend the service if you break these terms, don't pay, or misuse the service, after telling you where it is reasonable to do so. We can also end it for any reason on 30 days' notice, refunding any fees paid for the period after it ends.
- On ending, we disconnect every inbox and calendar, and delete enquiry data and your staff's sign-in accounts within 30 days, except anything we must keep by law. You can ask for an export before then. The data processing agreement has the detail.
12. Liability
Nothing here limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.
Otherwise:
- We are not liable for lost profits, lost business, lost enquiries or lost opportunities, or for indirect or consequential loss.
- Our total liability in any 12-month period is limited to the fees you paid us in that period, or £100 if the service was free.
- Claims about personal data are instead subject to the limit in our data processing agreement (clause 15).
This reflects that the service assists your team rather than replacing it, that you set the information it replies from, and that you choose whether replies are sent or held for approval.
13. Events outside our control
Neither of us is responsible for a delay or failure caused by something outside its reasonable control, such as a failure at Google, Microsoft, a portal or an internet or power provider, a cyber attack we could not reasonably have prevented, or government action. The affected party will tell the other and do what it reasonably can to limit the effect. This does not excuse paying fees for service already provided.
14. Changes to these terms
We may update these terms. If a change materially affects you we will tell you by email at least 30 days before it takes effect, and an owner of your account will be asked to accept the new version in the dashboard. If you do not accept it, you may cancel before it takes effect without penalty, and we will refund any fees paid for the period after you cancel; otherwise using the service after it takes effect counts as accepting it. Changes the law requires may take effect sooner.
15. General
- Whole agreement. These terms, the data processing agreement and the plan you choose are the whole agreement between us about the service. Neither of us relies on anything said that is not in them, but this does not limit liability for fraud.
- Transferring the agreement. You may not transfer these terms to someone else without our agreement. We may transfer them to a company that takes over our business, and we will tell you if we do. We may use subcontractors, but stay responsible for what they do; the data processing agreement governs those that handle personal data.
- Notices. Notices to you go to the email address of your account's owner; notices to us go to hello@leadsafterdusk.com. Email counts as writing.
- Third parties. Only you and we have rights under these terms; nobody else may enforce them under the Contracts (Rights of Third Parties) Act 1999.
- Waiver and severability. If either of us does not enforce a right straight away, it can still do so later. If a court finds part of these terms unenforceable, the rest still applies.
- Relationship. Nothing in these terms makes us partners, agents or employees of each other.
16. Law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
